Background

 

Litigation Finance is an alternative to stock markets and property investments. In recent years the genre has developed into interest from Investment Houses, Family Offices, Hedge Funds and Private Investors.

 

Funding of cases provides access to Justice for Claimants who would otherwise be unable to seek redress.

 

The cases funded have a track record of success and all invested money is applied to individual cases that have been vetted by the legal experts involved. Confidence in the robust case law that backs these has enabled the involvement of an After The Events Insurer who provides a back stop of capital protection plus 12% p.a. for the first 2 years of any case no matter of the outcome.

 

Undisclosed commission cases can be found in several B2B and Consumer Relationships. These include:

 

·     Second Charge CCA loans.

·     Commercial Finance.

·     Energy Contracts.

·     Car Finance.

 

 

 

The case law includes several High Court binding decisions which lay out the misgivings of relationships whereby intermediary brokers do not disclose secret commissions to their clients. This has meant that the clients who believed they were getting the best deal available in fact were being sold based on the highest secret commission a broker could achieve.

This principal is treated as a bribe in law as both the product provider and broker are held responsible for their secret relationship unbeknown to the customer.

 

The two most recent case law is that of Woods v Commercial First which was handed down at the Court Of Appeal in March 2021 and Johnson and Wrench v FirstRand Bank and Hopcraft v Close Brothers Oct 24 also at the Court Of Appeal.

 The Structure

 

A newly formed Barristers Chambers with no liabilities and a current work in progress of

£38,000,000 in case fees. E-Chambers Direct Ltd has been created to bring together experienced barristers working with expert witnesses who have specialist knowledge and a history of winning these case types.

 

The invested money covers legal disbursements such as expert reports, barristers’ opinion and Court fees.

 

 

 

Investor Return

 

The investor receives 15% to 30% return depending on investor level on a pro rata basis so if a case settles early the investment can be returned with the interest or an option is given to re-invest.

 

In the event the case fails 12% p.a. has been built into the insurance policy covering the case so not only is the capital protected but also a return for deployed funds.

 

A strict criterion is adhered to by the legal team to ensure that full protection is given in each case.

Are the legal team regulated?

 

Yes, all Barristers are regulated by The Bar Standards Board.

How will I know which case has been funded and that the insurance has been applied?

 

A Loan Note Certificate of the investment is given with the case management number on to identify the case funded and a policy number of the insurance.

 

 

Who can invest?

 

This opportunity is available ONLY to Sophisticated, Self-Certified, HNW/UHNW Investors. as defined by the FCA

 

What is the minimum investment?

£20,000.

 

 

Can I get updates?

 

Yes, full transparency of the case progression is available albeit we protect individual data relevant to GDPR.

 

 

What is the capacity for large investments?

 

Currently there is a stock of over 200 cases that require immediate funding, and more are being introduced monthly. The objective is to raise more than £20,000,000 to buy and progress more of this work. We are currently processing in excess of 30,000 cases with our bespoke AI system.

 

 

What if cases settle early?

 

Some cases settle in 9 months, and you will be given the option to withdraw or to re-invest in other cases. Typically, investors take the interest back and re-invest the capital in new cases but that’s your choice.

 

What happens if the case goes on for longer than 2 years?

 

In this scenario the investor can apply to move the case to new investors and their original capital returned. The case would still be running so either the interest due on a win or the insured return would be held until the outcome of the case. This ensures that both the initial investor and the subsequent one get the return expected.

 

 

What information do you need about me?

 

Checks are made to ensure the status of each investor to make sure it complies with current FCA

regulation. Money laundering checks will be completed for every investor.

 

 

Can I discuss my interest with a member of the Legal Team?

 

We insist on that. It is important that we speak to every investor, to establish suitability before asking for a transfer of funds.
